Recently, many netizens in Guangzhou reported on social platforms that their pet dogs were poisoned and died. On November 16, the Guangdong Provincial Pet Industry Association reported that more than 40 pet dogs have been confirmed to have died due to suspected poisoning. The affected areas include multiple districts in Guangzhou. Among them, the number of cases reported in Baiyun District, Haizhu District and Panyu District More.
At present, the Guangdong Provincial Pet Industry Association has established a special working group to comprehensively sort out and verify relevant information, and cooperate with a team of lawyers to collect and confirm information. At the same time, the association has maintained close communication with relevant government departments, actively cooperated with the police investigation, and jointly promoted the development of the incident in a positive direction.
According to lawyer analysis, poisoners who poison pet dogs need to bear corresponding legal responsibilities from three aspects: civil, administrative and criminal.
At the level of civil liability, because pet dogs belong to other people’s property and the poisoner infringes other people’s property by poisoning, according to Article 1165 of the Civil Code, if the actor causes damage due to wrongful infringement of the civil rights and interests of others, he shall bear tort liability; " Article 1167 of the Civil Code stipulates that if an infringement endangers the personal or property safety of others, the infringer has the right to request the infringer to bear tort liability such as ceasing the infringement, removing obstacles, and eliminating danger. Accordingly, the poisoner shall bear civil liability for compensation.
At the level of administrative responsibility, Article 30 of the "Public Security Administration Punishment Law" stipulates that manufacturing, buying and selling, storing, transporting, mailing, carrying, using, providing, disposing of explosive, toxic, radioactive, corrosive substances or infectious disease pathogens and other dangerous substances If the case is serious, he shall be detained for not less than ten days but not more than fifteen days; if the circumstances are relatively minor, he shall be detained for not less than five days but not more than ten days. Accordingly, poisoners will face public security penalties.
In terms of criminal liability, if a poisoner poisons a pet dog, he will inevitably put poisonous food in it, which will cause unspecified pet dogs or other animals to eat by mistake and die. What's more, it may even cause harm to people, which violates the Criminal Law. Article 114 stipulates: Anyone who releases poisonous, radioactive, infectious disease pathogens or other substances or uses other dangerous methods to endanger public safety without causing serious consequences shall be suspected of the crime of releasing dangerous substances and shall be sentenced to fixed-term imprisonment of not less than 3 years but not more than 10 years. The lawyer emphasized that if the poisoner targets a specific pet dog or other animal, rather than an unspecified pet dog or other animal, and the value of the pet dog or other animal exceeds 5,000 yuan, he is suspected of intentionally damaging property and can do so. Hold the poisoner criminally responsible.
From physical harm to poisoning, from malicious abandonment to intentional abuse, current violence against pets presents diverse characteristics. These violent acts not only endanger the lives and bodies of animals, but also cause indelible psychological trauma to them. At the same time, the covert nature of these behaviors also poses huge challenges to law enforcement and punishment. In the existing social governance system, there are serious regulatory blind spots in pet protection. The lack of a systematic supervision mechanism makes it difficult to detect and stop many abuse incidents in a timely manner. Even if illegal acts are discovered, it is often difficult to effectively punish the perpetrators due to difficulties in obtaining evidence and insufficient punishment.
Numerous studies have found that criminals who abuse animals are more likely to commit violent crimes against their loved ones. Among domestic violence victims who owned pets, 71% said that the domestic abuser had threatened to harm or abuse or kill the pets at home, and 57% of them reported that their partners had actually abused or killed the pets. This suggests that patterns of animal cruelty behavior may be directly linked to violent criminal behavior.
In view of this, we recommend accelerating animal protection-related legislation, clarifying the legal liability for animal abuse, and increasing the cost of violating the law. Improve law enforcement procedures, improve case handling efficiency, and form effective legal deterrence. At the same time, we will improve the community supervision system and establish an early warning mechanism for pet injuries. Encourage social forces to participate and form a nationwide supervision network. Strengthen publicity and education to raise public awareness of animal protection.
